STABILOY® XHHW-2 Mr. Heater (portable kerosene heater) Promotion

TERMS AND CONDITIONS

By clicking “Agree” (or similar), you (“Customer”) agree that you have had an opportunity to review and are consenting without reservation to the following terms and conditions of this STABILOY® XHHW-2 Mr. Heater portable kerosene heater Promotion (“Promotion”).

A. GENERAL:

1. Qualifying entries must be received by Alcan Cable Products Corporation, Cable division (“Alcan Cable”) between February 8, 2010 and March 12, 2010 (the “Term”) by submission of the registration form available at www.cable.alcan.com/XHHW-2. No purchase is necessary.

2. This Promotion will expire at midnight, eastern standard time, on March 12, 2010. Time of receipt of registration will be as reported by Alcan Cable. Note that receipt by a STABILOY® distributor, Alcan Cable employee or otherwise not in conformance with these terms and conditions does not constitute receipt by Alcan Cable.

4. A limited quantity of four (4) $389 Mr. Heater portable kerosene heaters (“Prize”) will be offered through this Promotion. One Customer shall be chosen at random to receive the Prize. First drawing will be held the week of February 22, 2010, with the additional drawings held one per week until the end of the Term. The first prize will be awarded March 19, 2010. Winner need not be present.

5. Alcan Cable shall have no obligation to provide a Prize if Customer’s delivery address set forth on the entry form is incomplete or incorrect or if delivery is refused, returned or otherwise hindered through no fault of Alcan Cable. Customers may contact Alcan Cable for the name of the Customer who was awarded the Prize.

6. By accessing this website or by participating in this Promotion you are agreeing to the terms of Alcan Cable’s privacy policy as described in Section 12 below.

C. HOW TO APPLY:

1. Prior to the end of the Promotion Term, Customers must submit a complete registration form through the STABILOY® XHHW-2 website.

2. Alternatively, Customers may submit a printed registration form to Alcan Cable at the above address. Paper entries must be received by Alcan Cable prior to the end of the Term.

D. OTHER:

1. No Combination. This Promotion may not be combined with other Alcan Cable promotional or discount offers such as rebates, special pricing or volume discounts.

2. Eligibility. This Promotion is open only to professional electrical contractors resident in the continental US and Canada. This Promotion is not open to residents of US Territories. The Promotion is not open to Alcan Cable authorized dealers, distributors or resellers, or their employees, dealers or employees of Alcan Cable or its affiliates.

3. Registration Requirements. Qualifying registrations must include all information requested in the registration form and must be submitted electronically through the website address provided to you. Alternatively, paper entries may be submitted as described above. Facsimile or email entries are prohibited.

4. Registration Conditions and Limitations. Limit one registration per Customer. Customer is responsible for submitting its own registration and any costs associated therewith. By submitting your registration, you agree to allow Alcan Cable to release your name to other registrants and Alcan Cable Customers in announcements regarding the Promotion and the Promotion winner.

5. Content and Intellectual Property. The content of the Promotion materials shall remain the sole and exclusive property of Alcan Cable. Participation in this Promotion does not confer upon Customer any rights to the Promotion materials, trade name, logo, trademark, or brand names of Alcan Cable, Rio Tinto Alcan Cable Inc. or their affiliates.

6. Right to Audit and Reject. Alcan Cable reserves the right to audit all Promotion claims and entries to ensure that these terms have been met, and to request additional information regarding any and all claims and supporting documents. Alcan Cable reserves the right to confirm the identification of all registrants. Where Alcan Cable determines that the terms of this Promotion have not been met or other evidence of fraudulent conduct or abuse of the Promotion, Alcan Cable reserves the right to deny the Promotion claim. The submission of false, misleading, incorrect or fraudulent documentation may result in disqualification from the Promotion. Incomplete submissions will be rejected with notice to claimant, when such notice is possible in light of the information submitted.

7. Compliance with Law. All federal, state and local rules and regulations apply. Promotion is void where taxed, regulated, restricted or prohibited by law. Alcan Cable and its affiliates reserve the right to modify this Promotion, add additional offers, or to cancel this Promotion, at their discretion for any reason.

8. Limitation on Liability. Alcan Cable is not responsible for late, lost, stolen, misdirected, illegible, incomplete or postage due claims or requests or for any printing, human or other errors. Alcan Cable shall under no circumstances be liable to Customer whether under statute, contract, negligence, tort, common law or otherwise for any consequential, punitive, indirect or direct loss, loss of profit, loss of use, delay, or for any other losses, liabilities, costs and damages whatsoever and howsoever arising. Alcan Cable is not liable for the acts or omissions of Bass Pro Shops, its employees, agents or officers.

9. Taxes. Customer shall be responsible for any taxes based on the award of the Price. Alcan Cable shall be responsible for any taxes based upon the income of Alcan Cable.

10. Choice of Law. In the event of dispute, the parties agree that the internal laws of the State of Georgia, other than its choice of law rules, shall govern.

11. Force Majeure. Neither party shall be responsible for failure or delay due to causes beyond its control in performing under these terms, except, in the case of Customer, its obligation to register before the end of the Term. These causes shall include, but not be restricted to, fire, storm, flood, earthquake, explosion, accident, acts of any public enemy, war, rebellion, insurrection, sabotage, terrorism, epidemic, quarantine restrictions, labor disputes, or controversies (including disputes or controversies which exist by reason of the refusal of either party to prevent, settle, or resolve such dispute or controversy on terms unacceptable to it), labor shortages, transportation embargoes, or failures or delay in transportation, fuel or energy shortages, power interruptions or failures, acts of God, acts, rules, regulations, orders or directives of any government or political subdivision, agency or instrumentality thereof, or the order of any court, regulatory, or arbitral body of competent jurisdiction.

12. Privacy and Confidentiality for STABILOY® XHHW-2 Promotion. Alcan Cable is committed to respecting your privacy. Please read the following policy to understand how your personal information will be treated. This policy may change from time to time so please check back periodically.

a. What information is collected? During your review, application for and participation in the Promotion and through your access to this Web Site, you can make requests and/or receive materials. The types of personal information collected through these Web pages and Promotion processes are your name, company affiliation(s), e-mail address and standard contact information, including addresses and phone numbers.

b. How is information used? Alcan Cable will not sell, rent or lease your personally identifiable information to others without your consent. The information you provide will be used to support your customer relationship with Alcan Cable, its parent company, Rio Tinto Alcan Cable Inc. and their affiliates. Alcan Cable also reserves the right to publish your name in a list of Promotion participants. Your information may be shared with agents, contractors or business partners for the purpose of performing services for Alcan Cable.

We want to help you quickly find information from Alcan Cable and alert you to specific offers, updated information, and other new products and services from Alcan Cable. Accordingly, we may send you direct mailings or contact you by telephone about our various products and services or other products and services we feel may be of interest to you. If you do not want to receive such mailings, simply “opt-out” by the means provided for in the mailings or by contacting Alcan Cable at the address provided in Section B above.

Please be aware that Web sites that have links on our site may collect personally identifiable information about you. The information practices of those sites linked to Alcan Cable either through advertisements or other hyperlinks are not covered by this privacy statement.

We may share the personal data you provide with other Alcan Cable agents, contractors or our business partners for the purposes of performing services for Alcan Cable. Alcan Cable also may share aggregated data with others. Aggregated data does not include personally identifiable information. We also believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of these terms, or as otherwise required by law. Except as provided above or in the event of a merger, consolidation, or sale of all or substantially all of Alcan Cable’s assets, we will not share any of your information with any third party without your permission.

c. How do I access, update or delete my information? You can request the individual information that Alcan Cable has collected about you, correct factual inaccuracies in your information, remove personal information from Alcan Cable’s data bases and/or update your personal information by contacting Alcan Cable at the address provided in Section B above.

d. What does “opt-out” mean? To “opt-out” means that you have notified Alcan Cable that we no longer have permission to use your information for a particular purpose. For example, when we send you information on a new product, you have the opportunity to “opt-out” of receiving such information in the future.
